Understanding RDAP Eligibility
Understanding RDAP eligibility is crucial for those aiming to reduce their sentence through the Federal Bureau of Prisons’ 500 Hour Residential Drug Abuse Program (RDAP).
To for qualify for RDAP, inmates must have a history of substance abuse one year prior to their offense. Substance abuse can include narcotics, prescription drugs, or alcohol. This history must be documented in the inmates PSR Presentence Investigation Report.
While a judge’s recommendation at sentencing can be helpful, it doesn’t guarantee entry into the program. Sentence reductions vary based on the original sentence length, with those serving 37 months or more being eligible for up to a 12-month reduction.
Due to overcrowding, actual reductions often average between 6-9 months.
Sentence Reduction Tiers
The amount of time shaved off your sentence depends on your original sentencing length:
Sentences of 37 months or more: Up to 12 months’ reduction.
Sentences between 31-36 months: Up to 9 months’ reduction.
Sentences less than 31 months: Up to 6 months’ reduction.
Please note that due to program overcrowding, the average sentence reduction across the Bureau of Prisons tends to be around 6-9 months.
